Former New Orleans' Talk Host Caught On Video Making (S)exual Advances Towards Cabbie, Found Guilty Of Mischief

7

THE MOUTH, JANUARY 19TH, 2015 –– A New Orleans attorney and former WGSO/New Orleans' radio talk host accused of filing a false police report against the cabdriver who filmed her sexual advances toward him during a cab ride three years ago, was found guilty of misdemeanor criminal mischief last Friday (Jan. 16), according FOX 8 NOLA. Jennifer Gaubert, who was convicted in April of simple battery against driver Hervey Farrell, escaped a more serious felony charge of making false statements, the station reported. Farrell had originally faced charges of extortion and video voyeurism following a 2013 cab ride, with Gaubert claiming the cabbie emailed her attorney threatening to expose the video unless she paid him. But prosecutors declined the charges, leading Farrell to bring a federal lawsuit against New Orleans police and the city over his arrest. Farrell shot video of Gaubert which was entered into evidence during the simple-battery trial of Gaubert. Judge Paul Sens convicted Gaubert on April 2 of touching the cab driver without his permission. Farrell has now filed a federal civil rights lawsuit against the New Orleans Police Department for the way they initially handled the matter. WARNING: NSFW - WATCH HERE

Another Setback For Sirius XM In Turtles' Copyright Suit

THE MOUTH, JANUARY 16TH, 2015 –– A New York federal judge mostly rejected Sirius XM Holdings Inc's request to reconsider her Nov. 14 decision in favor of members of the 1960s band The Turtles over the payment of royalties for songs made before 1972. According to reuters.com, Judge Colleen McMahon rejected Sirius' arguments that Flo & Eddie Inc did not own copyrights in The Turtles' recordings or gave it an "implied" license to play Turtles songs. She did agree that Flo & Eddie could recover damages for copyright infringement only for the three years before it sued on Aug. 16, 2013, not six years as she had previously suggested. The lawsuit is among others that Sirius and Pandora face over their playing of songs recorded before Feb. 15, 1972. Though such songs are not covered by federal copyright law, some recording artists and labels have won rulings entitling them to copyright protection under individual state laws. Flo & Eddie has filed lawsuits in New York, California and Florida, seeking more than $100 million for Sirius' alleged infringements. In September, a federal judge in California found Sirius liable for infringements under that state's laws.
