Florida Judge Rules In Favor Of Sirius XM Over Pre-1972 Music

THE MOUTH, JUNE 23RD, 2015 –– SiriusXM finally prevailed in a courtroom over its public performance of pre-1972 music. Flo & Eddie of The Turtles filed separate lawsuits in California, Florida and New York, aiming to use state laws against SiriusXM for misappropriating their common law rights to their songs such as 'Happy Together' and others played on satellite radio. California and New York judges have supported the argument. According to 3The Hollywood Reporter, This win streak came to a halt yesterday as Florida U.S. District Judge Darrin Gayles on Monday decided to rule in favor of SiriusXM's summary judgment.

Gayles wrote "Florida is different. There is no specific Florida legislation covering sound recording property rights, nor is there a bevy of case law interpreting common law copyright related to the arts." He continued, "If this Court adopts Flo & Eddie’s position, it would be creating a new property right in Florida as opposed to interpreting the law. Gayles says it's the job of the Florida legislature to address the issue, and if he were to step in, there would be difficultly resolving who sets and administers licensing rates, who owns sound recordings for dead artists and what exceptions there might be to a public performance right.

Apple To Pay Royalties In Trial Period Following Swift Tiff

3THE MOUTH, JUNE 22ND 2015 –– As if there's any doubt that Taylor Swift is one of entertainment' most powerful stars, less than 24 hours after Ms. Swift complained publicly that Apple was not planning to pay royalties during it three-month trial period, the company quickly backtracked and then confirmed it will pay its full royalty rates for music during the free trial.

“When I woke up this morning and read Taylor’s note, it really solidified that we need to make a change,” said Eddy Cue, Apple’s senior vice president of Internet software and services. This followed Taylor's note on her Tumblr page, called “To Apple, Love Taylor” where she posted she would be withholding her '1989 from the service. She posted: “We don’t ask you for free iPhones .. "I find it to be shocking, disappointing, and completely unlike this historically progressive and generous company.

3In less than a day, Apple Senior Vice President of Internet Software and Services Eddy Cue responded, "We hear you @taylorswift13 and indie artists. Love, Apple," added #AppleMusic will pay artist for streaming, even during customer’s free trial period — Eddy Cue Cue told Re/CODE Sunday night that Swift's letter and complaints from other artists prompted the change and that Apple CEO Tim Cook agreed to the move. Cue reached out directly to Taylor on Sunday and let her know that we heard her concerns,and wanted her to know that we were making changes," Cue told Re/CODE. Radio Speaks Up On Charleston Killings

THE MOUTH, JUNE 22ND, 2015 –– Radio hosts from across America took to their mics last week speaking out on the tragic killing of nine church goers at the storied Emanuel A.M.E. Church in Charleston. According to The New York Times, Hot 97 New York's Morning Host Ebro Darden shifted from his usual banter to say,, “Don’t just try to sweep what’s happening in America under a rug and not deal with the real issues,” before breaking down in tears. “The black church is really all we got .. It’s the last place that we always know ...” Down in Atlanta, VP/Urban programming, Reggie Rouse commented “When something like this happens, whether it’s Charleston or Ferguson, we have to stop the music and open up the phone lines.” It' V-103, like other urban stations, hosted interviews with local political and religious leaders, and also carried President Obama’s news conference on the killings live. A lot of those folks had never really heard our position articulated,” he said.

In South Carolina, Stephen Crumbley, the PD at Charleston’s mainstream urban station, 99.3 the Box and sister station Star 99.7, 3said “There was a great deal of tension and we wanted to calm that tension by giving people the complete story,” Mr. Crumbley said. “We were really worried about people taking the law into their own hands and we were trying to keep a sense of calm.” At least two people employed by his stations grew up attending Emanuel, according to Mr. Crumbley, while many more had some connection to the dead. “It’s family — we’re telling them it’s going to be O.K.,” he said. “That’s what radio is supposed to do.” Frank Ski, a veteran radio host whose show airs on WHUR 96.3 in Washington (and former longtime host of V-103), appeared as a guest on Q100 (WWWQ-FM, 99.7) in Atlanta on The Bert Show. Nationally syndicate TV/Radio host, Glenn Beck visited AME in Charleston on Friday after saying on his show on Thursday that he wanted to stand for peace in the community. He was accompanied by his wife, Rabbi Irwin Kula, and a bishop from Birmingham, Alabama. He wrote on his Facebook page, "This is not a rally but rather a personal journey where we can pray together and show our support." he posted a photo of himself with the words "Charleston Your Life Matters."

Billboard Reveals Top To Bottom Media Salaries

Syndicated Radio Hosts; Local Morning Show Top Radio Earners

THE MOUTH, JUNE 22NDE, 2015 –– With the headline "Who makes more, a radio show host or an 'SNL' Music Booker? Billboard Magazine compiled a list to determine who's pulling in the largest (or smallest) paychecks in the industry. Among the findings, it reports that a local morning hosts and syndicated shows take in the top dollar on the radio side, but over at TV being a late night band leader or even TV booker draws some pretty impressive bucks, as well.

3Billboard writes that the job of morning radio air personalities is much more work-intensive, but they tend to be well-compensated, and their salaries are augmented by endorsements, appearance fees, ratings-based bonuses.

Of note, morning hosts in both medium and small markets appeared to draw quite impressive salaries, from $100K-$200K on the high end. PD's appeared to garner lucrative salaries as well, ranging in small to large markets from $90K to $250K.

Not surprisingly, station mascots were on the bottom end of radio salaries. Story to appear in June 27th issue of Billboard.

REPORT: 2Day Network To Offer Kyle & Jackie O $12 Million To Return

THE MOUTH, JUNE 22ND, 2015 –– Jockline readers are well familiar with the Australian radio power couple of KIIS-FM's 101.1Kyle and Jackie O. Now comes word that Kyle Sandilands and Jackie Henderson will reportedly be offered $12 million by former employer Southern Cross Austereo in a bid to bring back the pair to its longtime home on 2Day FM.

According to smh.com.au, the show left the network after contract negotiations failed and were made an offer of $10 million from rivals Australian Radio Network to join KIIS 101.1 FM. Now, according to The Daily Telegraph, Southern Cross Austereo is now preparing to make a bid to lure back the rating's dominant Kyle and Jackie O Show after their split some 19-months ago.

Sandilands said an offer of $12 million was appealing, but he wouldn't return to the 2Day Network just for money. "I just don't jump through hoops for money any more," he said. "But I'm happy for Southern Cross to throw money at us because whatever they throw, ARN will throw more back so it just drives my price up." Popular NH Host Andy Blacksmith Passes Away While Awaiting Heart Transplant

THE MOUTH, JUNE 22ND, 2015 –– Andy Blacksmith, one of the long-time members of the Greg And The Morning Buzz show has died. Blacksmith passed away on Saturday, June 20, 2015 at Brigham and Women’s Hospital in Boston after being airlifted on Tuesday from a Portsmouth Hospital following heart complications.

"Morning Buzz" host Greg Kretschmar said in a statement. "Andy was truly a one-of-a-kind personality whose absence will be felt for a long time." The unionleader.com report that Blacksmith, who would have turned 50 next month, was open with listeners about his heart condition after being diagnosed five years ago. Complications set in Tuesday, when he was flown to Boston from Portsmouth Regional Hospital. Blacksmith's ill health kept him off the air at times. He had spent several months already this year at Brigham and Women's. The final post on his Facebook page was on June 4, when he told friends and fans that he hoped to be going home soon.

The Fitz Show's Ellen Tailor Vies For Spot On 'The Bachelor'

THE MOUTH, JUNE 22ND, 2015 –– Ellen Tailor (center), co-host of the syndicated Fitz In The Morning Show in Seattle appears to be working on her 'charm' smile in case she has to ask Fitz for six week's off during filming of ABC's "The Bachelor." They are currently embarking on a nationwide search for contestants. Tailor was one of the many hopefuls but she didn't go alone.
